			<content:encoded><![CDATA[<p>When I read Madhu Pandit Dasa’s <strong><a title="opens new window" href="http://www.harekrsna.com/sun/editorials/07-11/editorials7567.htm" target="_blank">recent post</a></strong> I was wondering why he waited almost a month to do so  and also why he didn’t include a link to my original article <em><strong><a title="new window" href="http://www.harekrsna.com/sun/editorials/07-11/editorials7428.htm" target="_blank">Madhu Pandit dasa: Prince of Prevarication and Father of Lies</a></strong></em>. (I request the gentle reader to read it and refresh their memory.)</p>
<p>Then I understood, he hoped that people would by this time have forgotten the catalog of lies he has perpetrated and which I had documented and thus be willing to swallow his latest offering.<span id="more-1482"></span></p>
<p>In his most recent text Madhu Pandit writes in regards to myself: “He has failed miserably to <strong>prove his allegations</strong>, so much so that he does not even respond to the challenge put to him in his so-called reply.”</p>
<p>The so-called challenge of Madhu Pandit was made in<strong><em> <a title="new window" href="http://www.harekrsna.com/sun/editorials/06-11/editorials7389.htm" target="_blank">Challenging the Bangalore Correspondent</a></em></strong></p>
<p>But what allegations did I make that Madhu Pandit is challenging me on? He is referring to the following article <strong><em><a title="new window" href="http://www.harekrsna.com/sun/editorials/06-11/editorials7355.htm" target="_blank">Madhu Pandit dasa to Offer Compromise Proposal</a>? </em></strong>In this article I only wrote two paragraphs as follows:</p>
<p style="padding-left: 60px;">
“The above notes that ISKCON did not run to Madhu Pandit, but the reverse. Why? Because Madhu Pandit knows that he will lose in the Supreme Court, and after the Supreme Court come criminal proceedings against him, which he can&#8217;t escape.</p>
<p style="padding-left: 60px;">
It will be interesting to see what Madhu Pandit&#8217;s proposal will look like considering that for the last 12 years he has been demonizing ISKCON, the GBC, ISKCON devotees, etc. But now that his skin is on the line, suddenly he will get a new perspective. Must be some connection between the above and what I just read on another blog:&#8221;</p>
<p><strong>So what allegations in these two paragraphs is Madhu Pandit challenging me to prove? </strong>None. Madhu Pandit obviously was in so much haste that he didn’t bother to read what little I actually wrote and separate that from what was written by others. I strenuously object to and resent his challenge to me that I have to prove statements that I didn’t make. <strong>I am in no way obligated to prove statements I didn’t make.</strong> It seems that Madhu Pandit is having some sort of break down and beginning to lose it. In any case it is beneath my dignity to have a battle of wits with an unarmed man who cannot even read what is actually written.</p>
<p>One may ask why did I write <em><strong><a title="new window" href="http://www.harekrsna.com/sun/editorials/07-11/editorials7428.htm" target="_blank">Madhu Pandit dasa: Prince of Prevarication and Father of Lies</a></strong></em> in the first place? Because I used it as an opportunity to showcase Madhu Pandit&#8217;s history of deceit.</p>
<p>As for Madhu Pandit’s explanation of how the Hundi is handled in the Bangalore temple, etc., we have only his word on it and we are supposed to believe that. This from a man who has made<strong> <a title="new window" href="http://www.harekrsna.com/sun/editorials/07-11/editorials7428.htm" target="_blank">false statements on sworn affidavits </a></strong>and for the last 10-12 years has made a profession of lying and we are now supposed to naively accept what ever he states to be gospel truth. The same goes for any future explanation given by Madhu Pandit or anyone hired by him. He got his <strong><a title="new window" href="http://www.harekrsna.com/sun/editorials/07-11/editorials7489.htm" target="_blank">auditor to falsify documents</a> </strong> so he would do the same with any person who he hires to certify his bona fides.</p>
<p>Madhu Pandit trots out the letter from Jayapataka Svami as a shield to hide behind but it is Madhu Pandit’s lies, deceit, frauds, and criminal activities that took place <strong>after </strong>this time that we are concerned about so he should stop resting on his past laurels. In World War 1 Marshal Petain was hailed in France as a war hero but in World War 2 he was denounced as a traitor who had collaborated with the Nazis. Similar is the condition of Madhu Pandit.</p>
<p>While Madhu Pandit spends his time taking the readers on tangential fantasy excursions hoping that they will believe him and regain his credibility it is all a waste of time for every one. Because the real people that Madhu Pandit will have to convince that he is not a liar, fraud and criminal do not read the Sampradaya Sun. Beginning on September 23, 2011 in Delhi before the<strong> Supreme Court of India</strong>, that is where Madhu Pandit Dasa will have to prove that the High Court of Karnataka got everything wrong and that actually Madhu Pandit is innocent. Any guesses on who will be believed?</p>
<p>In conclusion regarding Madhu Pandit’s vain challenges: <strong>a person is not obligated to prove statements that they didn’t make</strong>.</p>

		<title>Auditor Hired by Madhu Pandit das Held Guilty of Falsifying Accounts</title>

<p><strong>Jul 14, 2011 — BANGALORE, INDIA (SUN)</strong> — On May 23rd, 2011 the High Court of Karnataka concluded that the ISKCON Society registered in Bangalore in 1978 is a defunct entity having no legal existence, and by fabricating documents and<strong> falsifying accounts</strong>, Madhu Pandit dasa and his family members are falsely claiming the ISKCON temple at Bangalore as the property of the defunct society. The ISKCON temple at Bangalore is the property of the ISKCON society registered in Mumbai, and Madhu Pandit dasa is only the President of the Bangalore branch of ISKCON registered in Mumbai.<span id="more-1477"></span></p>
<p>In further setbacks to Madhu Pandit dasa, the <strong>Institute of Chartered Accountants of India</strong> (ICAI) has independently concluded that V. L. Varadrajan, the person hired by Madhu Pandit das to prepare Account Statements in the name of the defunct Bangalore society, is &#8220;<strong>guilty of professional misconduct</strong>&#8221; . The ICAI has a Code of Conduct, through which it monitors and controls the conduct of its members.</p>
<p>Till the year 2000, like every other branch president of ISKCON in India, Madhu Pandit dasa, the branch President of ISKCON Bangalore, submitted annual account statements to the ISKCON head office at Juhu, Mumbai for consolidation and submission to the Income Tax authorities.</p>
<p>In 2001, he began to fraudulently claim that the ISKCON temple at Bangalore never belonged to ISKCON registered at Mumbai, and that it always belonged to the defunct society registered at Bangalore. <strong>However, to legally claim the Bangalore ISKCON temple in the name of the defunct society, Madhu Pandit dasa needed account statements in the name of the defunct society. And to accomplish this, Madhu Pandit dasa hired the services of auditor V. L. Varadarajan and generated fraudulent account statements in the name of the defunct society.</strong></p>
<p>&#8220;In 2005, the Mumbai head office of ISKCON had complained to ICAI against Mr. V. L. Varadarajan for deceptively signing back dated Account Statements for a period of 12 years from 1989 to 2001 in one stroke.&#8221;</p>
<p>&#8220;Madhu Pandit Das used these fabricated Account Statements to fraudulently claim the ISKCON Temple as the property of his defunct society. In para # 69 of its judgment dated 23 May, 2011, the Hon&#8217;ble High Court of Karnataka<strong> held that the accounts of ISKCON Bangalore were manipulated by Madhu Pandit Das with the help of V. L. Varadarajan</strong> &amp; now the ICAI has reconfirmed the same&#8221;, said Dayaram dasa, the Chairman of the Legal Committee of ISKCON.</p>
<p>The Disciplinary Committee of ICAI, which conducted a thorough investigation after scrutinizingly studying the case, has submitted its report and <strong>held V. L. Varadarajan guilty of professional misconduct for signing fraudulent back dated Account Statements of the defunct society</strong>.</p>

<p>Following are excerpts from the proceedings of the Institute of Chartered Accountants of India regarding their investigation of V. L. <p style="padding-left: 60px;">&#8220;17. Therefore, the Committee is of the view of that <strong>despite providing sufficient opportunity of being heard,</strong> the Respondent had chosen not to present before the Committee without any valid ground. Therefore, considering the above, the Committee decided to proceed ahead with the matter.</p>
<p style="padding-left: 60px;">[The accountant Varadarajan was too afraid to even appear before the committee and only sent a lawyer. He also stalled for as much time as possible to delay the case.]</p>
<p style="padding-left: 60px;">24.2 As far as the Financial Statement for the accounting year 1990-1991 is concerned, the Committee noted that the<strong> Respondent had signed two set of financial statements for the year ending 1990-91 which appears to have been prepared from one set of Books of accounts </strong>as both the financial statements contains almost similar items and similar figures, for e.g. unsecured loan, investments, advertisement expenses, festival expenses. electricity expenses, devotee maintenance etc.</p>
<p style="padding-left: 60px;">[Part of the fraud required filing taxes for the defunct society, and to do so they used ISKCON's accounts.]</p>
<p style="padding-left: 60px;">24.5 However, the Committee noted that <strong>the Respondent had denied that he was auditor of ISKCON India</strong> for the financial year 1990-91. In this context, it has been noted that even in case where the Respondent was not auditor of ISKCON India, then in that case also, <strong>the question arises as to how he had signed two set of Balance Sheet as on 31st March, 1991 of ISKCON Defunct. Bangalore on different dates showing the different financial position of ISKCON Defunct</strong>. Therefore, the Respondent is <strong><span style="color: #ff0000;">guilty </span></strong>of professional Misconduct falling under clause (7) of Part I of Second Schedule to the Chartered Accountants Act, 1949.</p>
<p style="padding-left: 60px;">24.6 With regard to the charge that all the Financial Statements from the year 1988-89 to 2000-2001 were signed by the Respondent, <strong>which were filed in one stroke in 2001</strong>, the Committee observed that Respondent carried out audit and signed the Financial Statement for the aforesaid years, <strong>which appears to have been prepared from Books of Accounts of ISKCON India Bangalore&#8217;s Branch</strong>. All the Balance Sheets from 1998-89 to 1999-2000 were filed in one stroke, and there was an order of the Income Tax Directorate Exemption, which stated that whatever had been filed was the replica of the branch account of ISKCON India.</p>
<p style="padding-left: 60px;">Further, the Respondent did not submit any specific submission denying that the same were not prepared from one set of books. Therefore, he is <strong><span style="color: #ff0000;">guilty </span></strong>of &#8220;Other Misconduct&#8221; falling within the meaning of Section 22 read with Section 21 of the Chartered Accountants Act, 1949.</p>
<p style="padding-left: 60px;">24.7 The Committee noted that that the Respondent had signed the audit report and financial statements of ISKCON Defunct for the accounting years 1991-92 to 1997-1998 on behalf of the firm, V.L.V. &amp; Co <strong>despite the fact that that the said firm was closed </strong>on 01st June, 1992. Further, the Respondent also signed a certificate dated 25.01.2005 verifying the books of accounts and other records of ISKCON, Bangalore on behalf of the firm, M/s. V.L.V. &amp; Associates. The said firm, M/s. V.L.V. &amp; Associates, <strong>was closed</strong> on 22.12.2003. Therefore, it is amply clear that the Respondent deliberately signed the Audit Reports, Financial Statements and Certificate <strong>on behalf of the firm, which was not in existence at the time of signing</strong> of the Audit Reports, Financial Statement and certificate.</p>
<p style="padding-left: 60px;">Therefore, the Respondent is <strong><span style="color: #ff0000;">guilty </span></strong>of &#8216;Other Misconduct&#8217; falling within the meaning of Section 22 read with Section 21 of the Chartered Accountants Act, 1949.</p>
<p style="padding-left: 60px;">CONCLUSION:-</p>
<p style="padding-left: 60px;">25. In conclusion, in the considered opinion of the Committee, the Respondent is<strong><span style="color: #ff0000;"> guilty of professional misconduct</span></strong> falling under clause (7) of Part I of Second Schedule and &#8216;Other Misconduct&#8217; within the meaning of Section 22 read with Section 21 of Chartered Accountants Act, 1949.&#8221;</p>

<p>Please excuse my delayed response to Madhu Pandit dasa&#8217;s text, <strong><em><a title="opens new window" href="http://www.harekrsna.com/sun/editorials/06-11/editorials7389.htm" target="_blank">&#8220;Challenging the Bangalore Correspondent&#8221;</a></em></strong>. It takes longer to write non-fiction than to write fiction.<span id="more-1469"></span></p>
<p>Generally when we interact with genuine devotees, the expectation is that it be characterized by &#8220;simplicity.&#8221; By that we mean &#8220;straightforward&#8221; dealings devoid of duplicity (Bg 17.16 and Purport). Therefore we accept what they say or write as being true. But, can we do the same with Madhu Pandit dasa? Can we take whatever he says or writes on face value?</p>
<p>To decide that, let&#8217;s study his history of actions and statements.</p>
<h3>Is Madhu Pandit dasa Trustworthy?</h3>
<p>This link shows how Madhu Pandit dasa<strong> lied about his<a title="Madhu Pandit Dasa lied about his educational qualifications" href="http://www.madhubandit.info/2009/02/16/madhu-pandit-dasa-lied-about-his-educational-qualifications/" target="_blank"> educational qualifications</a>.</strong></p>
<p>Then Madhu Pandit <strong>lied on oath</strong> in a court affidavit that he only learned about the Rtvik philosophy in 1998, and this compelled him take his course of (illegal) activities. But in actuality, he had known about it for many years before 1998 and had repudiated Rtvikism. But when he later found that he needed support for his illegal activities, he embraced Rtvikism and became a Rtvik evangelist. He used the Rtvik controversy as a convenient expedient to carry out his crimes. 			<content:encoded><![CDATA[<p>We just got to see Madhu Pandit&#8217;s talk to Bangalore devotees regarding the 06 June status-quo. It was an eye opener as one gets the shocking realization that he is controlling this group like a cult. <strong>A personality cult to be precise.</strong> Unfortunately the video is designated &#8220;private &#8216; and unless you get a permission from the cult, you cant see it on Youtube!<span id="more-1461"></span></p>
<p>The way he plays the gullible crowd is shocking and tragic. Isolated from the court events and the reality of the dispute the devotees hear <strong>only his version of it</strong>. And they lap it up like innocent children. Rather than stating the gravity of the situation he spins a web of half-truths and lies and exploits the sentiments devotees have for the Deities. He whips up passions to fight! Shouts of &#8220;Hari Bol &#8221; from the crowds followed his deft statements that stoked hatred and anger as he openly instigated them to fight. He compares it to Krsna asking Arjuna to fight a dharmic war. &#8216;Lets fight&#8217; is the refrain he repeated all through. Its shocking !</p>
<p>Most of the devotees are new, having joined after the fraud was committed. So they have no idea of the nature of the manipulations that took place before they joined unlike the<strong> early ones all of whom have left</strong>. Kept isolated &amp; strictly <strong>monitored like prisoners</strong> these devotees do not know the devotees from other ISKCON centers. This is very convenient for MPD as he can paint them all as demons.</p>
<p>But are the opponents atheistic demons? How many of the devotees see the opposition as devotees like themselves who are serving in the movement that Srila Prabhupada founded? The real ISKCON. How many devotees are aware that these &#8216;demoniac&#8217; opponents have been asking MPD to stop the fight, stop wasting time &amp; money, offering to settle things? These so called demons have agreed to allow the practice of his concocted &amp; ever changing versions of the Ritvik philosophy in the temples.[Editor: They do?] Do they know that it is Madhu Pandit who dragged these &#8216;Demons&#8217; to court?  Who is the Demon here? Think!</p>
<p>While some raised a few serious &amp; relevant questions, MPD&#8217;s answers were passionate rabble-rousing responses than sensible or realistic answers.  At one point he even adds that they cannot touch any of his other projects and gives them all a false sense of security even as the Supreme Court refused a stay sought on the High Court findings that MPD &amp; his family were indeed crooks. No one asked, &#8221; What if we lost in the supreme court too, like we did in the high court?&#8221;</p>
<p>How many of them are aware that MPD is dragging them also into <strong>criminal </strong>liability? How many know that they are being used? As cover ups for a series of fraudulent &amp; criminal activities. MPD knows his case is full of holes with his own evidences contradicting each other. He knows his fabricated fraudulent documents have no chance of winning at the Supreme Court having been exposed fully by the High Court. The same documents &amp; evidence will reach the Supreme Court. The fraudster knows very well his own fraud better than anyone else and yet he bluffs &amp; cheats people who have trusted him. Cheats them into being partners in crime and implicating them into false cases that will mess up their lives totally.</p>
<h3>So why does he do this?</h3>
<p>He needs people now. Money he has in plenty. He needs to show the he has a cause worth fighting for. A cause that 300 devotees are fighting for. He has to look like a leader, a jihadi with a genuine cause. He has to have a base of people so that his lawyers can say &#8221; My Lord , hundreds &amp; thousands of devotees are with him&#8221;. This way the Judge will have some consideration for him when they see that he is just another Ramalinga Raju or A. Raja. This is his only hope.</p>
<p>So with no knowledge of the nature of the cases and being in total denial of what the High Court has established after a thorough  investigation a whole bunch of innocent devotees are allowing MPD to gamble with their lives. Its amazing that such things are possible even today and that people like MPD can do such things to devotees with such impunity. This is exactly what Kirtananda x-Swami, Bhagavan Das x-Goswami and Jayathirtha x-Swami did with their foolish followers. We all know what happened to them and yet history repeats itself! It is indeed as Srila Prabhupada says &#8211; a society of the cheated &amp; the cheaters! This is very sad for those poor devotees. Really Sad. When will these devotees become independent souls who can think for themselves?</p>

			<content:encoded><![CDATA[<p style="text-align: left;">There is some <strong>confusion </strong>(created by whom?) on what was gained at the Supreme Court with the Hill even celebrating a victory being fooled by Madhubandit&#8217;s version of it. They even accused Dayaram of fooling the news papers with his version, as if they were as sheep minded as the followers of the Bandit.  So here it is in simple terms for all those with sheep mentality brain to chew on &amp; on.<span id="more-1443"></span></p>
<p style="text-align: left;">MPD&#8217;s lawyers asked for the High court order of 24rd May to be squashed or stayed.  <strong>The Judge refused.</strong></p>
<p style="text-align: left;">They then asked a status-quo as on 23 of May &#8211; so that the High court verdict gets ineffective . <strong>The Judge refused that too.</strong></p>
<p style="text-align: left;">They sought a restraint on the supervisory committee from ISKCON Mumbai &#8211; that was<strong> refused too by the Judge!</strong></p>
<p style="text-align: left;">What they finally got was a <strong>status-quo as on 6th June 2011</strong>.   What does that mean?</p>
<p style="text-align: left;">It means the High Court verdict that the property belongs to Mumbai stands as on today.<br />
However, the day to day management by MPD&#8217;s team can still continue as a branch of Mumbai.</p>
<h3 style="text-align: left;">Here &#8211; read the order:</h3>
<p style="padding-left: 60px; text-align: left;"><em>Having heard the learned counsel appearing for the parties and examining the prima facie merit or otherwise of the contentions raised,</em><br />
<em> we are of the considered view that the following orders need to be passed at this stage:</em></p>
<p style="padding-left: 60px; text-align: left;"><em>1. Issue notice.</em><br />
<em> 2. Ms. B.Vijayalakshmi Menon, Advocate accepts notice.</em><br />
<em> 3. In the meantime, counter affidavit may be filed.</em><br />
<em> 4. The matter shall be listed for consideration/continuation of the interim orders immediately after reopening of the Court.</em><br />
<em> 5.<strong> In the meanwhile, the parties shall maintain status quo, as of today</strong> [June 6, 2011]. However, the Bangalore Society with its present office bearers shall continue day-to-day management of the Society but would not take any major and policy decision created liabilities of any kind from the Bangalore Society.</em></p>
<p style="text-align: left;">Now, how is that a victory in any way for MPD?</p>
<p style="text-align: left;">But we hear that the new story from MPD is that &#8221; Krsna entered the heart of the Judge and spoke of a settlement &#8221; !!!  Therefore he is working on a peace proposal to be given to ISKCON !! ( as if its ISKCON who is trapped like a rat! ). Everyone should please note that it is not because MPD realizes that he will lose the case in the Supreme Court like he did in the High court! It is only because of Krsna played a direct role in matters by entering into the heart of the Judge that MPD is doing this . Mind it!  As to why Krsna did not enter MPD&#8217;s heart &amp; tell him directly is a divine mystery !</p>
<p style="text-align: left;">So after using <strong>false claims</strong> of fighting for ideology and for Srila Prabhupada, the bandit amassed wealth &amp; stole the temple into a family trust while dragging Srila Prabhuipada&#8217;s movement into court battles &amp; ugly screaming sessions on TV costing crores of rupees of loss for Srila Prabhupads&#8217;s movement. He is now using the same false front of Ideology to escape from the consequences of tampering with the law, of being a criminal. He is putting forth a peace proposal to save the ideology ( not himself &#8211; mind it ) !</p>
<p style="text-align: left;">What is the real reason for this peace mongering ? <strong>Fear</strong>.</p>
<p style="text-align: left;">Fear that he will lose in the Supreme Court just like he did in the High Court. Fear that criminal charges will be slapped on him and the trustees for swindling crores that came to the Hundi of Bangalore temple into private trusts belonging to his family members. <strong><a title="What do Madhu Pandit Dasa and Ramalinga Raju have in common?" href="http://www.madhubandit.info/?p=449" target="_blank">These are serious crimes and jail terms are not small or light.</a></strong> To all those in the broad of trustees this is a caution. Please think for yourself and understand that these are criminal deeds that you all are involved in. Its not a little matter any more. You are all party to crime as per the standing High court order upheld by the Supreme court.</p>
<p style="text-align: left;">But there is good news. Not everyone on the Hill are fools. Quite a few are making peace deals as you read this. More will follow.</p>

<p><strong>It seems nothing is going in favour of ISKCON Bengaluru. To start with, the High Court of Karnataka had ruled that the entire property of the International Society for Krishna Consciousness (ISKCON) in Bengaluru, belongs to ISKCON Mumbai.</strong> Now, ISKCON Bengaluru has to deal with hate messages from unknown miscreants[?].<span id="more-1428"></span> The head of the communications and public relations cell of ISKCON Bengaluru, Bharatharashabha das, has sought the help of cyber police to block the websites that are misleading [informing] the public and painting a negative [real] picture of ISKCON&#8217;s initiatives and programmes. Mr. Das wanted the police to block the following websites:</p>

<p>A cyber crime officer who is investigating the case said that the case has been booked under the IT Act. He said that Mr. Das claims that unidentified elements want to &#8220;mislead [inform] the general public and paint a negative [realistic] picture about the initiatives and programmes taken under the leadership of Madhu <span style="text-decoration: line-through;">P</span>Bandita das.&#8221; Going by the names of the websites, the intention seems to be to propagate hate and vilify the leader of ISKCON Bengaluru and Akshaypatra, Mr. Das claims.</p>
<p>The officer says &#8220;the misleading propaganda unleashed through a series of websites seems to have been floated by one single group.&#8221; &#8220;The case is under investigation and we are in the process of tracing those who have created these websites. We have also requested the concerned IP provider to block these websites following the complaint,&#8221; the investigating officer added.</p>

			<content:encoded><![CDATA[<p style="text-align: center;">EXCERPTS FROM JUDGEMENT GIVEN IN THE HIGH COURT OF KARNATAKA AT BANGALORE IN RFA 421/2009</p>
<h3 style="text-align: center;">ISKCON (Defendents/Appellants)<br />
Vs.<br />
Madhupandit Das’s so called ISKCON society (Plaintiffs/Respondents)</h3>
<p>In the aforesaid judgement the honorable judges at various places held that various frauds have been committed by Madhupandit Das (MPD). The instances and the exact wordings given in the judgement are given hereunder:<span id="more-1419"></span></p>
<h3 style="text-align: center;">MPD’s so called ISKCON society is<br />
illegal and dead</h3>
<p>1.	On page 29, para no. 27, while referring to the constitution of the plaintiff society, it is held that,</p>
<p><em>“the plaintiff society is not a legally constituted body.”</em></p>
<p>2.	On page 29, para no. 28, it is held that,</p>
<p><em>“There is no evidence on record to show as to when Madhupandit Das, the President of the plaintiff Society, Stoka Krishna Das, the Secretary of the plaintiff society and other office bearers were admitted as members of the plaintiff society.”</em></p>
<h3 style="text-align: center;">MPD created fraud documents</h3>
<p>3.	On page 31, para no. 29, it is held that,</p>
<p><em>“In the instant case, the plaintiff society has not produced any order passed by the Registrar of societies condoning the delay caused in filing the reports and accepting the reports filed by the plaintiff society. Further, a perusal of these reports indicate that they are tailor made to suit the convenience of the plaintiff society. It is noticed from these reports that some portions of the resolutions are typed, some portions are handwritten and some portions are computer sheets. Some portions are antidated and some other resolutions are passed from the place when the same was not in the possession of the plaintiff.”</em></p>
<p>4.	On page 32, para no. 30, it is held that,</p>
<p><em>“From 1978 till March 2002 the plaintiff society has not filed its return of income with the Income Tax Department.”</em></p>
<h3 style="text-align: center;">MPD Tampered with Documents</h3>
<p>5.	On page 34, para no. 32, while referring to documents relating to telephone connections it is held that,</p>
<p><em>“A perusal of these documents specify that there are insertions and the round rubber seal of the plaintiff society was affixed at a later stage.”</em></p>
<p>6.	On page 36, para no. 34, while referring to evidences of copies of returns filed under the Sales Tax Act, it is held that,</p>
<p><em>“It is also seen from these documents that there are insertions and affixing of the round rubber stamp seal of plaintiff society in an unusual manner.”</em></p>
<p>7.	On page 37, para no. 35, while referring to insufficient documentary evidences produced to prove existence of plaintiff society, it is held that,</p>
<p><em>“Therefore, the plaintiff society<strong> miserably failed </strong>to prove that it had legal existence as an independent autonomous body engaged in spreading the ISKCON movement at Bangalore.”</em></p>
<h3 style="text-align: center;">MPD Cooked up documents and hid from Court</h3>
<p>8.	On page 49, para no. 46, while referring to resolution passed by the management committee of the plaintiff society supporting the wrong declaration made by Madhupandit Das, it is held that,</p>
<p><em>“This resolution by the Management Committee of the plaintiff society is a unilateral document cooked up for the purpose of this case…… Though the plaintiff society mentioned the name of Madhupandit Das in its list of witnesses filed before the Trial Court, he was not examined. Thus the plaintiff withheld the best evidence with an intention that if he is examined, his evidence would go against the plaintiff. Non-examination of this important witness Madhupandit Das is fatal to the case of the plaintiff.”</em></p>
<h3 style="text-align: center;">MPD Manipulated BDA Records</h3>
<p>9.	On page 55, para no. 50, while referring to illegal insertions in possession certificate issued by Bangalore Development Authority (BDA), it is held that,</p>
<p><em>“Therefore, the draft possession certificate Ex. P. 203 containing the round rubber stamp seal of the plaintiff society is a concocted document and the same <strong>cannot be believed</strong>.”</em></p>
<p>10.	On page 59, para no. 54, while referring to certified copies of documents issued by BDA, it held that,</p>
<p><em>“The certified copies produced before the Court specify that certain pages are missing from the BDA record, certain insertions are made in the BDA record and there is tampering of certain documents. This material on record do not repose confidence in the mind of the Court that the plaintiff society applied for allotment of land and the same was allotted to it and it took possession of the same.”</em></p>
<h3 style="text-align: center;">MPD’s Conspiracy to steal ISKCON Temple</h3>
<p>11.	On page 71, para no. 65, while referring to various correspondence by Madhupandit Das, it is held that,</p>
<p><em>“Up to the year 1999 in the entire correspondence and the judicial proceedings as stated above there is no reference with regard to the existence of plaintiff society. No material is placed on record to show that the plaintiff society was engaged in building the ISKCON movement in the state of Karnataka and in particular in Bangalore city.”</em></p>
<p>12.	On page 73, para no. 67, it is held that,</p>
<p>“On one side, theological differences. On the other side, the action of defendant No. 1 (i.e. ISKCON Mumbai) to suspend Madhupandit Das. Further Madhupandit Das failed to get temporary injuction in O.S. No. 4467/2000 and O.S. No. 1483/2001. At the same time Madhupandit Das and his associates were not ready to give up their control and authority over the huge assets of Bangalore branch. <span style="color: #ff0000;"><em><strong>Richer the endowment, greater will be the temptation to swallow the same.</strong></em></span> <strong>Under these circumstances, Madhupandit Das and his associates conspired to claim right of ownership not only over the income, but over the idol, the deity of the temple and the entire assets of the temple. </strong>Madhupandit Das and his associates had taken advantage of the identical name of the plaintiff society’s “International Society for Krishna Consciousness” and the defendant’s branch “International Society for Krishna Consciousness”. This is how Madhupandit Das and his associates started claiming that there was no defendants’ branch at Bangalore and the ISKCON movement at Bangalore was built by plaintiff society and the schedule properties belong to the plaintiff society.”</p>
<h3 style="text-align: center;">MPD Manipulated ISKCON Temple Accounts</h3>
<p>13.	On page 77, para no. 69, while referring to manipulation of accounts, it is held that,</p>
<p><em>“In the meanwhile <strong>Madhupandit</strong> Das and his associates <strong>manipulated the accounts </strong>in the name of plaintiff society and got audited from an auditor by name V. L. Varadaraj for 12 years from 1989 to 2000…… Thus it is clear that an attempt was made to give life to the defunct plaintiff society.”</em></p>
<h3 style="text-align: center;">MPD Family Cooked up Documents to Gain Control Over ISKCON Temple</h3>
<p>14.	On page 77, para no. 70, it is held that,</p>
<p><em>“Further, <strong>Madhupandit Das,</strong> his wife <strong>Bhakti Lata Devi Dasi</strong>, his co-brother <strong>Chanchalapati Das</strong>, his wife’s sister <strong>Chamari Devi Dasi</strong> and other close associates <strong>cooked up</strong> reports specifying the names of these persons as elected office bearers of plaintiff society and filed the same in the office of Registrar of Societies for the first time on 21.08.2001 for the entire period of 12 years from 1989 to 2001. <strong>As already stated these reports are cooked up for the purpose of giving life to the defunct plaintiff society.”</strong></em></p>
<p>15.	On page 78, para no. 71, while referring to the question raised in point no. 6 on page 20 as to, “<em>Whether the defendants prove that plaintiff society, by taking advantage of 1st defendant’s branch name ISKCON Bangalore is claiming illegally and fraudulently the schedule property as its property?”</em>, it is held that, <em>“Hence, point no. 6 is answered in ‘affirmative’.”</em></p>
<p>16.	On page 79, para no. 72, it is held that,</p>
<p><em>“The plaintiff society has miserably failed to prove and establish that it is the absolute owner in possession and enjoyment of plaint schedule properties. On the other hand, it is found that the plaintiff, a defunct society,<strong> by taking advantage of similarity in the name of Bangalore branch of defendant No. 1 </strong>and by <strong>fabricating documents</strong>, is<strong> falsely claiming the plaint schedule properties</strong>. There is no evidence on record to show that plaintiff society built the ISKCON movement in the State of Karnataka and it acquired the schedule properties.”</em></p>
<h3 style="text-align: center;">MPD is under ISKCON Bureau</h3>
<p>17.	On page 80, para no. 74, it is held that,</p>
<p><em>“Admittedly, Madhupandit Das and other full time devotees are heading the branch of defendant No. 1 at Bangalore. Therefore, Madhupandit Das and other functionaries in their capacity as President and functionaries of ISKCON Bangalore, as branch of defendant No. 1 are entitled to continue to function in accordance with the bye-laws, Rules and Regulations of defendant No. 1. However, it is made clear that their continuance as such shall be subject to the decision to be taken by ISKCON, Mumbai, in accordance with the bye-laws, Rules and Regulations of defendant no. 1.”</em></p>
<h3 style="text-align: center;">CONCLUSION</h3>
<p><strong>The Honorable High Court held that the ISKCON TEMPLE in Bangalore is not Madhupandit Das’s family business. It is a branch of ISKCON under the control of Bureau, the Governing Council of ISKCON registered in Mumbai. In other words, ISKCON Bangalore Temple is like any other 80 Temples of ISKCON in India.</strong></p>

Therefore, Madhupandit Das and other functionaries in their capacity as President and functionaries of ISKCON Bangalore, as a branch of defendant No. 1 are entitled to continue in accordance with the bye-laws, Rules and Regulations of defendant No. 1. <strong><span style="color: #ff0000;">However, it is made clear that their continuance as such shall be subject to the decision taken by ISKCON, Mumbai, in accordance with the bye-laws, Rules and Regulations of defendant No. 1.</span></strong></p>

<p>The Judges also made it clear when rejecting Madhu Pandit’s petition for a 90 day stay order that he would stay on for 6 weeks (up to July 4, 2011) as Branch President in Bangalore of ISKCON Mumbai.</p>
<p>“The bench had already specified that Madhu Pandit Dasa and others can continue in their posts <strong>with a requirement that that they should act as per bylaws and regulations of Iskcon, Mumbai</strong>.”</p>

<p>So unless Madhu Pandit Dasa wants to be<strong> in contempt of the High Cour</strong>t of Karnataka he must, per force of its ruling, act in pursuance of the bylaws and regulations of ISKCON, Mumbai. The following has just appeared in my inbox, a letter from H.G. Bhima Prabhu, General Secretary, Bureau*, ISKCON, to Madhu Pandit Dasa.</p>
<p>The ball is now in Madhu Pandit Dasa&#8217;s court; it will be interesting to see how he responds.</p>

<p>I have enclosed the said resolution (2 pages) along with explanation (3 pages). So totally  5 pages as annexure to this letter. <strong>The said resolution is in respect of appointment of Supervisory Committee by the Bureau</strong>.</p>
<p>As per section X.B. of the Rules &amp; Regulations it is the duty of every branch President and every other functionary of a branch to strictly comply with the resolutions of the Bureau.</p>

<h3>Proposal</h3>
<p>In light of the explanation provided at the end of this proposal it is resolved that</p>
<p style="padding-left: 30px;"><strong>1:</strong>“Bureau, in pursuance of the power vested in it by Section VII.I of the “Rules and Regulations” of ISKCON Reg. in Mumbai in 1971 (F &#8211; 2179),  hereby constitutes a supervisory committee ( hereafter referred to as the said Supervisory Committee) consisting of Sri Dayaram Dasa aka Dinesh Vinayak Kocharekar ( the Chairman), Sri Varadakrishna Dasa, <strong>Srimati Radhapriya Devi Dasi aka Srimati S. P. Rajeshwari**</strong>, Sri Muralishyam Dasa aka Muthuramalingam &amp; Sri Rajendra Kamatgoudar, in respect of Bangalore Temple/branch situated at Hare Krishna Hill, Chord Road, Rajaji Nagar, Bangalore with the following responsibilities:</p>
<p style="padding-left: 60px;"><strong>a.</strong> To check the system &amp; standard of Deity worship followed by the Bangalore branch.</p>
<p style="padding-left: 60px;"><strong>b. </strong>To check the system of cash handling followed by the Bangalore branch.</p>
<p style="padding-left: 60px;"><strong>c.</strong> To check the system of accounts followed by the Bangalore branch.</p>
<p style="padding-left: 60px;"><strong>d.</strong> In general to take stock of the present situation, happenings, all or any of the aspects of running of the Bangalore branch/temple as may be deemed necessary by the said supervisory committee or as may be directed by the Bureau.</p>
<p style="padding-left: 60px;"><strong>e.</strong>The committee, at the earliest, shall submit a report to the Bureau  whether interim or otherwise with recommendations if deemed essential.</p>
<p style="padding-left: 30px;"><strong>2.</strong> Sri Dayarama Dasa (the chairman) has right to add to and/or remove member(s) to the said Supervisory Committee as he deems fit. Further the members of the advisory committee can take help and assistance of or engage any person(s) as may be necessary to carry out the task entrusted to them. Madhu pandit Das is directed to pay expenses, if any, from the funds of the ISKCON Bangalore Temple /branch, if requested by the members of the said Supervisory Committee.</p>
<p style="padding-left: 30px;"><strong>3.</strong> It is made clear that the said Supervisory Committee will not get involved in the day to day management of the said Bangalore branch/Temple but will have all powers &amp; right to access any portion of the premises &amp; part thereof, all the records, all the data bases etc.</p>
<p style="padding-left: 30px;"><strong>4.</strong> Madhu Pandit Das, the Bangalore Branch President, Chanchalapathi Das, the Bangalore branch vice president &amp; other functionaries i.e. Jai Chaitanya Das, Stoka Krishna Das, Amitasana Das, Chitranga Chaitanya Das, Suvyakta Narasimha Das, Rajiv Lochan Das, Satya Gaur Chandra Das, Sridam Krishna Das, Vasudev Keshav Das, etc. are directed to give full cooperation &amp; support to the members of the Supervisory Committee including the following:</p>
<p style="padding-left: 60px;"><strong>a.</strong> Each member of the committee will have separate room in the Guesthouse to stay.</p>
<p style="padding-left: 60px;"><strong>b.</strong> The committee will get suitable place in the administrative block and will set up office with printers, computers, printing papers, tables, chairs, etc. Madhu Pandit Das and others will provide them with whatever things they need immediately upon request.</p>
<p style="padding-left: 60px;"><strong>c.</strong> Madhu Pandit Das and other functionaries are directed to instruct all the full time devotees and staff to furnish all the information to any member of the said Supervisory Committee as per their request. Further the said Supervisory Committee members will have free access to all the full time Devotees &amp; staff and may interview and/or otherwise interact with them as they deem fit. The Supervisory Committee is entitled to get information from all sources and if deemed necessary, hold discussions in private with the staff members, full time devotees, accountants, cashiers, etc. The branch office bearers shall fully cooperate with the members of the said Supervisory committee in this regard.</p>
<p style="padding-left: 60px;"><strong>d.</strong> All the Bangalore branch functionaries shall direct all the full time devotees, staff, suppliers, contractor, workers, etc. to answer any queries the committee members may raise and also furnish full and truthful information as per the request of the members of the said Supervisory Committee by issuing necessary written instruction(s).</p>
<p style="padding-left: 30px;"><strong>5.</strong> The committee is directed to complete the work and report back to the Bureau in 7 days time.</p>
<h3>Explanation</h3>
<p style="padding-left: 30px;"><strong>1.</strong> On 23rd May 2011 the Division bench of the Hon’ble High Court of Karnataka passed judgment in RFA 421/2011 dismissing the suit OS 7934/01 filed by Stoka Krishna Das, Madhu Pandit Das &amp; ors in the name of ISKCON registered in Bangalore in 1978 by Shankhabhrit Das. The said Judgment also decreed the counter claim of ISKCON (F-2179) registered in Mumbai by Srila Prabhupada in 1971.</p>
<p style="padding-left: 30px;"><strong>2.</strong>The said Judgment inter alia gives the following findings:</p>
<p style="padding-left: 60px;"><strong>a.</strong>The ISKCON Temple functioning at Hare Krishna Hill, Chord Rd., Rajaji Nagar, Bangalore, was always &amp; is a branch of ISKCON (F 2179) registered at Mumbai in 1971.</p>
<p style="padding-left: 60px;"><strong>b.</strong>ISKCON registered by Shankhbhrit Das in 1978 in Bangalore (henceforth Defunct Society) is an illegal and defunct entity &amp; Madhu Pandit Das &amp; other who are claiming to be office bearers of the Defunct Society are the office bearers of the Bangalore branch of  ISKCON (F2179) registered in Mumbai and may continue to act in that capacity if ISKCON (F 2179), registered in Mumbai so desires.</p>
<p style="padding-left: 60px;"><strong>c.</strong> Madhu Pandit Das and his associates have fabricated documents and manipulated accounts.</p>
<p style="padding-left: 30px;"><strong>3.</strong> After delivery of the above Judgment Madhu Pandit Das filed an application for stay of the operation of this judgment which was refused by the Division bench of the Hon’ble High Court but the court passed an order restraining ISKCON (F 2179) Reg. in Mumbai from removing Madhu Pandit Das &amp; others from the post of Branch President and other functionaries for the period of 6 weeks to enable Madhu Pandit Das to file SLP. But in the said order it was further clarified that Madhu Pandit Das and others will function only in accordance with bylaws of ISKCON (F 2179) Reg. in Mumbai.</p>
<p style="padding-left: 30px;"><strong>4.</strong> In para 71 (pg. 78) the said Judgment dt. 23rd May, 2011 has held that Madhu Pandit Das  and his associates, by taking advantage of similarity in the names of ISKCON (F 2179) Reg. in Mumbai and  Defunct Society are falsely claiming the ISKCON Bangalore Temple properties as the Properties of the Defunct Society.</p>
<p style="padding-left: 30px;"><strong>5.</strong> <strong>In the circumstances the Bureau is duty bound to act immediately </strong>at least to take stock of the present state of affairs at the Bangalore branch and also whether proper systems are in place to protect funds, properties at the Bangalore branch/Temple as well as whether Deity worship and other spiritual activities are carried out in accordance with the instruction(s) of Srila Prabhupada, the Founder of ISKCON (F 2179), Reg. in Mumbai. Hence the proposal.</p>
<p><strong>* The </strong><strong>Bureau </strong>was created by Srila Prabhupada in 1971 when he registered ISKCON in Mumbai. It is the ultimate legal owner and executive director of ISKCON India. While the International GBC has moral authority, the ISKCON Bureau has legal authority.This fact is not known much outside of ISKCON India.</p>
<p><strong>** A woman is present to protect the men</strong>. Why is that you ask? Because in the past when Varada Krsna Dasa went to visit Hare Krsna Hill, he was mercilessly beaten and hospitalized, realizing their mistake of beating him for no reason, Madhu Pandit Dasa through his “fixer” Mr. Ranjit Shankar, hired some prostitutes to falsely claim that Varada Krsna Prabhu had been “Eve teasing” (sexually harassing) some females at the temple and brought false charges against Varada Krsna Prabhu for the same. Varada Krsna Prabhu is still being harassed by these false charges. So to protect them from such false accusation a woman will always be present. It is advisable that anyone going to the HKH temple should be accompanied by a female relative to avoid such harassment from Madhu Pandit dasa.</p>

<p><strong>May 24, 2011 — BANGALORE, INDIA (SUN) —</strong> Before getting to the main matter of this text I would like to briefly comment on what Madhu Pandit dasa has written on<strong> <a title="Opens new window" href="http://www.iskconbangalore.org/ISKCON-Bangalore-goes-on-appeal" target="_blank">his website</a></strong>. Starting at paragraph five (5) where he begins with: &#8220;The genesis of this dispute between ISKCON Mumbai and ISKCON Bangalore…&#8221; First of all this is an <em>oxymoron</em> since the High Court of Karnataka has ruled that &#8220;ISKCON Bangalore&#8221; doesn&#8217;t exist as a legal entity; more on that later. The real point I want to make is that from here on, Madhu Pandit&#8217;s rant gives us the same old worn out slogans, like some bad Communist era newsreel or TV program, &#8220;<em>Victory to the proletariat working class that is fighting the Bourgeois Capitalist.&#8221;</em><span id="more-1387"></span> This army of platitudes in search of an idea may appeal to and be eaten up by his chosen constituency, as he has consciously portrayed himself as <em>the</em> true follower of Srila Prabhupada and become a Rtvik apostle and saint. But, is he even a real Rtvik or, has he also done a fraud here to portray himself as one, just to garner support for his crimes? The online article &#8220;<a title="Opens new window" href="http://www.madhubandit.info/?p=96" target="_blank"><strong><em>How Madhu Pandit Dasa duped the Rtviks in order to steal from ISKCON&#8221;</em></strong></a> explores this issue in detail, so I won&#8217;t get into it here, as I have already digressed enough.</p>
<p>Madhu Pandit dasa may fervently rehash his philosophical reasons for taking ISKCON&#8217;s Bangalore temple as his own so that he can &#8220;struggle for truth&#8221;, etc., however in no legal jurisdiction that I know of, and certainly not in India, does having a philosophical disagreement with someone justify committing fraud, perjury, bribery, forgery, thuggery and who knows what other crimes in order to steal the property of the person with whom you have the philosophical disagreement (especially when you are accusing your opponents of all the crimes that you are yourself committing). All criminals have rationalizations for their crimes, <strong>but these reasons do not excuse them of the crime</strong>. It is that simple.</p>
<p>Madhu Pandit is a capable and competent person. If he had serious differences he could have just left ISKCON like others have done and started his own organization in 1998. (Caru Prabhu in Utah comes to mind. He had differences with the GBC and had several successful projects he had developed taken from him. But did he resort to crime? No. He just went out on his own and started a very successful project in the Utah desert.) With his talents and abilities, by now Madhu Pandit would be very successful. Instead he chose to take what was not his in the name of Rtvikism, when in reality it was just that <strong>greed</strong> got the better of him. For as the High Court opined about Madhu Pandit: <strong>&#8220;Richer the endowment, greater will be the temptation to swallow the same.&#8221;</strong></p>
<p>What Madhu Pandit dasa and his supporters should realize is that the High Court of Karnataka do not care even one fig for all of Madhu Pandit&#8217;s philosophical rhetoric.<strong> All they want to know is if he has broken the law of the land or not?</strong></p>
<p><strong>Below are some excerpts from the High Court of Karnataka&#8217;s judgment against Madhu Pandit dasa</strong> by Their Honors Nagamohan Das and Arali Nagaraj. Following which is a link to the High Court of Karnataka&#8217;s website where you can down load the whole judgment for yourself. To better understand what the judges are referring to such as previous suits filed by Madhu Pandit dasa and also the documents that he forged and which were examined in the court and referred to by them, go to <a title="Opens new window" href="http://www.iskcon-bda.org/" target="_blank">www.iskcon-bda.org</a>, which has copies of most documents referred to by the High Court.</p>
<h3>Excerpts</h3>
<p style="padding-left: 60px;"><strong>46</strong>. … Though the plaintiff* society<strong> mentioned the name of Madhupandit [sic] Das in its list of witnesses </strong>filed before the Trial Court, he was not examined. Thus the plaintiff withheld the best evidence with an intention: that if he is examined, his evidence would go against the plaintiff. <strong>Non-examination of this important witness Madhupandit Das is fatal to the case of the plaintiff.</strong> The Trial Court, without considering these admissions on record committed an illegality in holding that no adverse inference can be drawn against the plaintiff. …</p>
<p style="padding-left: 60px;"><strong>67.</strong> … At the same time Madhupandit Das and his associates were not ready to give up their control and authority over the huge assets of the Bangalore branch. <strong>Richer the endowment, greater will be the temptation to swallow the same. </strong>Under these circumstances, <strong>Madhupandit Das </strong>and his associates <strong>conspired</strong> to claim right of ownership not only over the income, but over the idol, the deity of the temple, and the entire assets of the temple. …</p>
<p style="padding-left: 60px;"><strong>70</strong>. Further,<strong> Madhu Pandit Das</strong>, his wife <strong>Bhakti lata Devi dasi</strong>, his co-brother <strong>Chanchalapati Das</strong>, his wife&#8217;s sister <strong>Chamari Devi dasi</strong> and other close associates <strong>cooked up reports</strong> specifying the names of these persons as elected office bearers of plaintiff society and filed the same in the office of Registrar of Societies for the first time on 21.08.2001 for the entire period of 12 years from 1989 to 2001. <strong>As already stated these reports are cooked up for the purpose of giving life to the defunct plaintiff society.</strong></p>
<p style="padding-left: 60px;"><strong>74.</strong> Admittedly, Madhupandit Das and other full time devotees are heading the branch of defendant No. 1** at Bangalore. Therefore, Madhupandit Das and other functionaries in their capacity as President and functionaries of ISKCON Bangalore, as a branch of defendant No. 1 are entitled to continue in accordance with the bye-laws, Rules and Regulations of defendant No. 1. <span style="color: #ff0000;"><strong>However, it is made clear that their continuance as such shall be subject to the decision taken by ISKCON, Mumbai, in accordance with the bye-laws, Rules and Regulations of defendant No. 1.</strong></span></p>
